Q. We have employees who live and work in Cali??for??nia. We get frustrated that we are not allowed to have them sign a noncompete agreement. Is there anything we can do?

A. The enforceability of most noncompetition agreements and similar restrictions on post-employment competition generally depends on the common law or statutes of the state in which an employee lives and works, or the law chosen in an employment agreement.

Unlike Minnesota, California and certain other states? common law or statutes prohibit nearly all employee noncompetition agreements. There is, however, a potential option to incentivize employees not to compete, by using certain compensation plans regulated by federal law rather than any state?s.

The Employee Retirement Income Security Act (ERISA) is the federal law that regulates certain em??ployee benefits such as health plans and pension plans. Cer??tain deferred compensation plans regulated by ERISA and related to more highly compensated employees, may contain forfeiture-for-competition provisions. Those provisions state that employees forfeit later payments of deferred compensation if they have competed with the company after their employment ends.

One advantage to these forfeiture-for-compensation provisions is that ERISA pre-empts state laws. That means California?s and other states? laws prohibiting noncompetition agreements do not apply to their enforcement.

Of course, these plans may not be right for all employers, and they must be drafted to meet ERISA re??quire??ments. Under certain circumstances they can create a significant incentive for employees not to compete after they leave the company.

Such was the case this week at his annual news conference, when he greeted with a hard scowl the subject of pending Russian legislation that would ban Americans from adopting orphaned children. Mr. Putin unleashed invective on the fact that consular representatives aren?t allowed to visit adopted Russian children in the United States.

As is often the case in Russia, there is the issue of what is going on versus what is really going on. And as is often the case in Russia, it?s complicated.

There is very little doubt as to the goal of the legislation, which passed its third and final reading in the lower house of parliament Friday and must still be signed by Putin. The bill is named after Dima Yakovlev, the toddler who died of heat stroke in 2007 after his adopted father forgot him in a locked car in Virginia for nine hours. The father, Miles Harrison, was acquitted of involuntary manslaughter in the death of Dima, whose adopted name was Chase. His acquittal in 2008 sparked banner newspaper headlines, incendiary TV news reports, and howls of outrage in Russia.

Lawmakers in the State Duma made it clear that today's legislation is a direct response to the US ?Magnitsky Act,? a law designed to sanction a particular group of Russian officials connected to the death of a whistle-blowing lawyer in a Moscow prison.

In other words, a law designed to punish people tied to a lawyer?s prison death has been answered with a law to prevent people from adopting orphaned children, many of whom have have developmental or other disabilities and will otherwise end up living much of their lives in orphanages that often resemble state mental hospitals of a bygone era.

Adoption is a searingly emotional issue for Russians, and one easily manipulated by the Kremlin. The institution of adoption is relatively uncommon in Russia, for cultural and other reasons. And judging by headlines in the Moscow tabloids, and the rhetoric of some state lawmakers, you?d think that Americans adopt Russian children to eat them.

Kenny Boynton, Florida Gators stop Air Force at Orange Bowl Classic

When Air Force coach Dave Pilipovich?s 20-year-old son found out his dad?s team was playing 14th-ranked Florida this season, his initial reaction was, ?Why??

In a way, the young man knew what he was talking about, because the Gators pulled away in the second half Saturday night to defeat Air Force 78-61 in the nightcap of the Orange Bowl Basketball Classic doubleheader at the BB&T Center in Sunrise.

The Gators (9-2) led just 33-31 after the first half, when the Falcons (8-3) shot 47.8 percent. But Florida?s defense, which ranks third in the nation in points allowed (51.3), stiffened in the second half, holding Air Force to 33.3 percent shooting.

?That?s a very good Florida team,? the elder Pilipovich said. ?We knew they?d come out sharper in the second half.?

Erik Murphy, Florida?s 6-10 senior forward, was named the game?s MVP after he scored 21 points on 8-of-10 shooting. He also had seven rebounds, four assists, three blocks, a steal and no turnovers.

Teammate Kenny Boynton, a 6-2 senior shooting guard playing in his fourth and final OB Classic, went out on top. He was held to three points in the first half but finished with 14.

Boynton entered the game in a 4-for-32 shooting slump from three-point range, but broke out with three made shots from distance in an eight-minute span of the second half.

?This is not the first time Kenny has gone through something like this,? Gators coach Billy Donovan said of the slump. ?What I always tell him is to take good, available shots. When he does that and makes a couple, then he can take more difficult shots.?

Boynton?s only first-half basket came on a three-point play in which he drove the lane, got fouled and made a short bank shot.

To his credit, Boynton never seemed to force the action, getting three assists and just one turnover, often driving and dishing to open teammates.

For the game, he made 4 of 10 shots, including 3 of 7 on three-pointers.

?I just tried to make sure I let the game come to me,? Boynton said. ?I watched a lot of film with Coach Donovan, and we saw that a lot of shots that I had been taking [during the slump] were contested or with a guy running out on me.?

Besides Murphy and Boynton, the other Gators player who scored in double figures was forward Patric Young, who had 13 points on 6-of-9 shooting. Most of his damage was done in the post.

Donovan also praised guard Scottie Wilbekin for his defensive effort on Air Force?s Michael Lyons, who entered the game ranked 20th in the nation with a 20.5 scoring average. Lyons was held to 11 points on 3-of-11 shooting.

Much of the attention in the postgame news conference centered on Boynton, the hometown hero who played his high school ball at Pompano Beach Ely and at Plantation American Heritage.

?It?s been a good career,? Boynton said when asked to reflect on his time at Florida. ?Every year, I?ve learned more. My goal is to get as far as we can and help my team in the NCAA Tournament.?

Boynton left high school with a lot of media members speculating he might follow prep rival Brandon Knight as a ?one-and-done? player, leaving college quickly for a shot at the NBA.

That type of talk upset Donovan.

?It?s unfortunate and unfair that people put these type of expectations on kids,? Donovan said. ?Whether he has a 10-year career in the NBA remains to be seen. Not every player?s game translates to the league.

?But Kenny is going to probably leave here as our all-time leading scorer and one of the greatest players in the history of the program.?

Murphy said he?s glad Boynton decided to stay all four years.

?We all have the utmost respect for Kenny,? Murphy said. ?He came in with a lot of hype. He probably could have left any year he wanted to, but he stuck around, and that says a lot that he wants to be with this team. We all love Kenny.?

Sanjay Sanghoee: Bankrupt Politics: The Republican Plan to Kill Our Economy

Forget the fiscal cliff. The real threat to the U.S. economy is not political stalemate in Washington but the Republican party itself.

From the time that President Obama first took office in 2009 through the elections in 2012, the GOP has been running on the platform of economic despair, and in fact, seems to have bet its entire future on it.

In the beginning it was easy, since the president had just inherited a massive financial crisis and a shattered economy that would take years to rebuild; all the Republicans had to do was stonewall any initiatives that would hasten a recovery, and wait. That gave them the edge they needed to rout the Democrats in the midterm elections. Following that, they adopted the strategy of blaming the financial stimulus package and Dodd-Frank for the continuing softness in the economy, which kept the pressure up on Obama and, more importantly, kept him on the defensive.

But now the landscape is different. Obama has four more years to do his thing, the disastrous Mitt Romney campaign has damaged the Republican party immeasurably, and the economy is visibly recovering, so the Republicans cannot just sit back and hope that everything will go wrong anymore. If the economy continues to grow, the president's second term will be a victory, period. That means the Republicans actually have to make sure it goes wrong -- or any hopes that they have of making meaningful gains in future elections will be dashed.

Which is why their new strategy is to actively derail the economy.

Think of it as the Republican long game -- if the U.S. falls back into a recession, the president's promises of a better future will be perceived as empty rhetoric and the Democrats will lose credibility, paving the way for Republican victories in 2014 and 2016. It may be pretty devious but it is also that simple.

To accomplish this goal, the Republicans seem to have settled on two angles of attack:

Cut Spending till it Hurts

Republican posturing on the fiscal cliff has revolved mostly around lower taxes for wealthy Americans, but what they really want is deep cuts in government spending (taxes are mainly a bargaining chip). The problem, of course, is that deep cuts in spending right at the cusp of economic recovery will likely send us back into a recession. From outright unemployment for federal workers to cuts in state and local government grants, spending cuts would stifle national growth almost overnight. The setbacks would impact nearly every sphere, including infrastructure, education, healthcare, financial reform, and consumer protection, leading to "domino effect" declines in consumer confidence, spending, commercial activity, employment, and ultimately the economy.

Granted we have a trillion-dollar deficit problem but deficit reduction also requires GDP growth and an increase in the tax base, which cannot happen in a declining economy; not to mention that any action that slows our momentum at this time would be counter-productive to the deficit in the long run since we will simply have to run up a bigger tab later.

The right approach would be to phase in spending cuts slowly and time them to succeed economic growth, not precede it. But that timeline would not suit the Republicans at all since it would take us further into Obama's term and enable him to take credit for a good economy. So, regardless of the fiscal cliff outcome, you can bet that the GOP will flog this horse well into next year and keep pushing for deeper and deeper cuts until they strike bone.

Manufacture Uncertainty

Nothing pours cold water on economic growth like uncertainty. When the rules of the game are defined clearly, even if they are unfavorable, all players can strategize accordingly and aim for success; but when businesses and consumers have no idea what is going to happen next, their plans just stall in the mire of nervousness. That is what happened during the debt ceiling debate of 2011 and in painful slow motion this year on the fiscal cliff. Despite dire warnings by economists of another recession if America goes over the cliff, and despite the financial soundness of letting the Bush tax cuts expire for the rich, the Republicans have done everything in their power to prevent a compromise from being reached. The net result has been an unnecessarily prolonged period of uncertainty and market tumult.

This is a clear-cut case of obstructionism with a purpose, and it will not stop with the fiscal cliff either. Christmas may be over but for the Republicans the first half of next year is an extended holiday season, with gifts ranging from another debt ceiling fight to further arguments on tax cuts and Wall Street reform all waiting to fall into their political laps. And they will exploit it all to create as much uncertainty about the future as they can, for that is the surest way to derail our economic progress and ensure that President Obama does not preside over a prosperous country for the next four years.

Compromise might help the Republican party regain its credibility with American voters but then Republicans have never been good at fighting from a positive place. They are much more comfortable playing offense, and that is why they will kill our economy if they can -- because it is their last, desperate, hope for survival.

So how will it stop?

It won't, unless the American public pulls their support of the party completely. Even if you agree with the Republicans ideologically, you should ask yourself whether a party that is willing to destroy your livelihood for political gain should be allowed to represent you at all... and then vote the opportunists out of office before they ruin the country!

New Android apps worth downloading: Instagram update, Pitfall!, Dueling Blades

If you?re still a fan of Instagram despite its policy change fallout, you?ll want to grab its latest update, which also serves as today?s leading fresh app and adds a new photo filter. What?s it like? The recently updated Twitter app also contains photo filters of its own, and alternatively, there?s Paper Camera for other cool effects.

What?s it about? Activision?s gaming classic has been reimagined as a third-person endless runner, much like Temple Run and similar titles.

What?s cool? Taking a page from the popular Temple Run, Pitfall! is mostly about running through the jungle and avoiding obstacles by jumping, sliding, and juking back and forth. But Activision has added a lot of other features, like animals you have to fight off with Harry?s whip, sections of the game that have you riding a moped scooter or running through a village, and more.

Who?s it for? Like other runners, Pitfall! is a fun and addictive way to waste a few minutes, so if you like games like that, check out this one.

What?s it like? Temple Run is an obvious comparison, as is Temple Run: Brave.

What?s it about? A mix of role-playing, fighting and turn-based strategy genres, Dueling Blades is a multiplayer fantasy game with an interesting way of depicting its battles.

What?s cool? As mentioned, Dueling Blades mixes elements of a number of genres to create its unique gameplay. It combines both real-time and turn-based strategy elements, meaning you and your opponents enter your moves for each turn at the same time, and they?re executed simultaneously. You?ll need to anticipate what your opponent is going to do, while they try to do the same with you. The game includes multiple classes of fighters from which to choose, and you can improve them over time as you play through either the story mode or Dueling Blade?s multiplayer mode.

Ouya developer console gets an official unboxing, flaunts transparent case (video)

It's a little early for an Ouya teardown, but Kickstarters who chipped in $699 won't have to wait long to see what the little console is made of -- Ouya's developer hardware is transparent. The console's team decided to cut the inevitable march of unboxing videos off at the neck, offering fans a quick preview of the package it's shipping out to devs. The standard accoutrements are there -- the tiny console itself, two prototype controllers with batteries, HDMI and power adapters, plus a micro USB cord and a letter to developers thanking them for their investment and warning them of the early build's bugs. The note also cautions deep-pocketed gamers that the device is built specifically for developer use, and has no games to placate eager couch potatoes. The video shows the console booting up, and even demonstrates how easy it is to open the hardware. Reduce Your Writing Time With Speech Recognition Software

I am always considering means of cutting down my writing time over all. One way to reduce writing time is using speech recognition software. I had heard of software programs such as dragon naturally speaking but never really invested enough time or thought into using them. Because we only have 24 hours available but between answering messages, writing blog articles, article marketing and writing articles it had been required to find methods for getting more time in the afternoon.

Integral Voice Acceptance

I first started using the integral speech recognition capabilities of Windows on my Toshiba. First, I am a person and honestly I did not expect much. I installed my microphone/web camera into the notebook and mentioned the speech recognition from the start-up menu. The original set-up takes you via a number of questions and also offers you repeat lines therefore the the application may "learn" you speech. After four hours of playing about I was willing to stop trying. My wife suggested I personally use her Plantronics Stereo PC Headset, since my microphone was picking right up every sound in the home.

I mounted my wife's headset into the laptop and began the process again. Just what a big difference! Not merely was the integrated speech identification picking up on my enunciation, however it was writing what within a few minutes after I talked. A simple demand corrects the concern and the device learns, If the plan makes an error. It's still faster than writing a write-up out, although the built-in recognition process does make some basic mistakes every now and then. One drawback concerning the integral characteristic is that it operates only on Microsoft software. Might work around is simply to influence directly into Word Pad and execute a basic copy and paste afterward.

Dragon Naturally Speaking 10 Regular

I decided to spend money on dragon naturally talking 10 Standard if there were more capabilities to see, since the integrated software was my first initiation into voice recognition capabilities. For example: To underline "lamp post," the model requires you to state "Select lamp post," then you must say,"underline lamp post". In a shareholder meeting last?summer, RIM CEO Thorsten Heins said the company was thinking about adding video chat to BBM when BlackBerry 10 hit the streets.

Newly leaked slides seem to suggest the feature has indeed made the cut and will be coming to a BB10 device near you when the new OS launches on Jan. 30, along with a new task manager.

Normally, we take leaked slides with a hefty pinch of salt. These images look fairly legitimate, however. Plus,?Engadget reports that the images have been "removed by request" at several sites across the Web, including the two CrackBerry forum posts that first revealed the pictures.

According to the slides, the video chat feature includes screen-sharing capabilities, a la Skype. The BBM 7 update earlier this month already added VoIP functionality to the service, though it's limited to your BBM contacts and will only work over Wi-Fi connections, not cellular. If the slides prove accurate, we'd expect the video chat feature to sport the same limitations.

Another slide shows "BlackBerry Remember," which???as you can see above???looks to be some sort of calendar-slash-to-do list-slash-project management tool, complete with Microsoft Outlook (and possible Evernote) integration.?

Charge won't be pursued against Swift trespasser

NASHVILLE, Tenn. (AP) ? Prosecutors on Thursday declined to pursue a criminal trespassing charge against a Wisconsin man arrested earlier this month for climbing a fence at a Nashville home linked to country star Taylor Swift.

Jacob Kulke, of Marshfield, Wis., will remain in jail in Nashville as he is fighting extradition to Colorado for probation violation. Kulke did not appear in court during his Thursday hearing. The 24-year-old Kulke was arrested Dec. 14 after climbing a fence and a gate at a home in Belle Meade that has been publicly linked to Swift.

The affidavit said Kulke claimed he was in contact with a person at the home through social media. He said he was dating her and it was her birthday and he wanted to surprise her. Swift was overseas at the time her spokeswoman has previously declined to comment on the case.

Sean McKinney, Kulke's attorney, said Thursday that prosecutors discussed the decision not to prosecute with representatives for Swift. He said that Kulke is not guilty of the trespassing charge and said that his client was tricked by someone into believing that he was communicating with the star. Kulke told police he rode a bus to Nashville from Wisconsin, and then took a taxi to the home.

"It is the defense's position that he was misled by someone else," McKinney said. "Mr. Kulke had reasonable belief that he was invited on to the premises."

McKinney said that prosecutors could still bring the charge back within the statutes of limitations, but no restrictions were placed on him by the prosecutors or Swift.

"He is still a big fan of Taylor Swift," McKinney said.

Assistant District Attorney Tali Rosenblum said that Kulke has already spent 13 days in jail and the trespassing charge is a misdemeanor that carries a maximum 30-day sentence. She said they wanted to resolve the charge in Tennessee so that authorities could extradite him to Colorado.

"Mr. Kulke is looking for his 15 minutes of fame and he got all he deserved," Rosenblum said.

NJ Lawmakers Fed Up With Outsourcing [AUDIO]

A resolution sponsored by Assembly members Annette Quijano, Wayne DeAngelo and Reed Gusciora urging Congress to establish tax incentives for businesses returning and maintaining jobs in the U.S has received final legislative approval.

To deter outsourcing, the resolution also urges the establishment of tax penalties for companies moving jobs overseas.

DeAngelo explains, ?This sends a message that the American public is tired of seeing their jobs outsourced, gone away to other countries. We want companies to know, if you have a job here and you want to leave this country and go elsewhere, we?re not going to go down without a fight.?

Under the current United States Tax code, the cost of moving personnel and company operations to a new location is defined as a business expense that qualifies for a tax deduction. The relocation of company operations include jobs that would normally go to U.S. citizens. Tax breaks, are currently not available to businesses that maintain jobs in the United States or bring jobs back into the country.

?With the unemployment rate fluctuating between 8% and 10% in the nation, we cannot afford to reward U.S. based Companies who give away the one thing this country truly needs right now? more jobs,? says Quijano. ?For many of these companies, our citizens are the reason their business is successful. By providing tax incentives in exchange for job creation will help us strengthen our workforce.?

Gusciora explains, ?New Jersey has one of the highest unemployment rates in the nation. A concerted effort must be made from top down to keep businesses here and create more job opportunities. We hope Congress can come together and do what is right for sake of the struggling unemployed in this country.?

The Assembly Concurrent Resolution urges Congress to take action, by amending the tax code, to provide incentives for companies returning outsourced jobs to the U.S. and to provide penalties for companies that move jobs to locations outside of the United States. The resolution was approved 75-0-2.

In the Upper House, Legislation sponsored by Senator Bob Gordon and Senate Majority Leader Loretta Weinberg intended to protect jobs for New Jersey?s middle class residents today has also been approved by the Senate Labor Committee.

The bill requires that any employer relocating a call center from New Jersey to a foreign country must provide notification and return any financial support given to the employer by the State of New Jersey. It also requires that the Department of Labor and Workforce Development maintain on their website a list of employers that are planning to move their call centers to a different country. Under the bill, fines of $7,500 a day would be levied for failing to notify the Department if a call center is relocated.

?It is inconceivable for the state to provide tax breaks to businesses to operate in New Jersey, only to then see the jobs shipped overseas,? says Gordon. ?In these tough times, we need to ensure that New Jersey?s tax dollars are being spent to support New Jersey workers.?

Weinberg says, ?By requiring businesses to notify the public in advance, their employees, their consumers and the general public will be made aware of the company?s business practices and can make decisions regarding their future involvement with the organization. Not only will this bill protect taxpayer dollars, it will protect New Jersey jobs by holding companies accountable that are outsourcing their workforce.?

Oil prices rise as 'fiscal cliff' talks to resume

BANGKOK (AP) -- The price of oil rose Wednesday after President Barack Obama indicated he would cut his Christmas holiday short and head to Washington to try to work out a deal to keep the U.S. from heading over the "fiscal cliff."

Benchmark oil for February delivery rose 49 cents at late afternoon Bangkok time to $89.10 per barrel in electronic trading on the New York Mercantile Exchange.

On Monday, concerns over the stalemate in Washington drove benchmark oil prices lower, with the contract closing down 5 cents at $88.61 a barrel on the Nymex.

Obama was expected to arrive in Washington early Thursday, the White House said, after a brief vacation in Hawaii. Congress was also expected to return to the U.S. capital Thursday and begin budget negotiations.

Hopes that U.S. leaders might reach a budget deal helped buoy oil prices. Failure to agree on a plan before Jan. 1 would lead to spending cuts and tax hikes that economists predict will push the economy back into recession. Otherwise, the economy is expected to show slight improvement in 2013, a positive for energy consumption and prices.

In other energy futures trading:

? Brent crude, used to price international varieties of oil, rose 45 cents to $109.25 a barrel.

? Natural gas fell 3.5 cents to $3.311 per 1,000 cubic feet.

? Heating oil rose 1.5 cents to $3.0034 a gallon.

? Wholesale gasoline rose 0.8 cents to $2.7588 a gallon.

I?m losing my hearing so my doctor has scheduled an audiological evaluation. What will this evaluation tell me?

DEAR READER:

An audiological evaluation identifies the severity of your hearing loss and the frequency range in which it occurs. This information may help identify the cause of your hearing loss. It?s also essential for determining whether you could benefit from a hearing aid and, if so, which style and type would help the most.

When a sound wave enters your ear, it hits the eardrum. Several tiny bones transmit sound waves from the eardrum through fluid, into the inner ear. There lies a snail-shaped organ called the cochlea that is covered with tiny hairs. These hairs generate electrical signals that travel along the hearing nerve (the auditory nerve) to the brain. (See illustration.)

How we hear Sound travels in waves through the air (A) into the ear canal (B), where it is amplified and vibrates the eardrum (C). The eardrum vibrates the tiny bones known as the ossicles (D), which transmit the vibrations through the oval window and into the fluid in the cochlea in the inner ear. The cochlear fluid (E) moves in waves, setting in motion the sensory hair cells inside the organ. The hair cells release electrochemical signals that travel along more than 30,000 auditory nerve pathways into the brain (F). ?

The evaluation is done by a hearing specialist, or audiologist, in a specially constructed booth that shuts out all unwanted noise. It tests the different parts of the ear that are necessary for hearing:

• Pure-tone test. Each of your ears, in turn, is exposed to sounds of different frequencies and decibel levels. (Frequency is the pitch of a sound. A decibel is the measurement of the loudness of a sound.) The pure-tone test identifies the quietest tones that you can hear at different frequencies.
• Next is a bone-conduction test. This test helps establish whether your hearing loss is primarily sensorineural (caused by damage to the cochlea, hair cells or auditory nerve) or conductive (caused by a blockage of sound transmission through your outer or middle ear), or a combination of the two. This test will also help determine whether your hearing loss can be medically corrected, and the kind of hearing aid you need.

Two additional tests will evaluate how well you hear and understand spoken words:

• Speech reception threshold test. You will hear words, instead of tones, through your earphones. The words start out loud and gradually get softer. The test identifies the decibel level at which you can understand and repeat only half of the words.
• Speech discrimination test. With age, many people can hear words loudly but not clearly. A speech discrimination test assesses how well you understand words. A high score on this test means that you are likely to benefit from a hearing aid. That?s because your problem in understanding a spoken word comes from not hearing the word loudly enough, and a hearing aid can amplify the loudness of sounds.

Today?s technology for testing your hearing has improved greatly since I was in medical school. Even greater advances have been made in hearing aids. They not only work better but they?ve also become tiny ? people often don?t notice you have one. For many of my patients, hearing tests followed by the right hearing aid has greatly improved the quality of their lives.

Start of "Santa Claus rally" dampened by "cliff' worries

NEW YORK (Reuters) - U.S. stocks edged lower on Monday as caution over the potential for volatility driven by worries about the U.S. "fiscal cliff" dampened enthusiasm at the start of a seasonally strong period for equities.

Investors are betting Congress will reach a deal to avert most of the austerity measures due to come into force at the start of next year. That has led to the best year for stocks since the post-financial crisis rebound. But those gains may be quickly reversed if a deal is not reached soon.

The S&P 500 index posted its biggest drop in more than a month on Friday as a Republican plan to avoid the cliff - $600 billion in tax hikes and spending cuts that could tip the U.S. economy into recession - failed to gain traction on Thursday night.

Sharp moves like that highlight how headlines from Washington can whipsaw markets, especially during the thinly traded period over the Christmas holiday.

Still, with the S&P 500 up 0.7 percent in December and on course for its strongest month since September, some analysts are predicting that stocks will find their footing during a market seasonality known as the "Santa Claus rally."

"Right now we've seen some very constructive action in the market so I think that bodes well for this being a positive seasonal 'Santa' period over the coming seven days," said Ari Wald, a technical analyst at The PrinceRidge Group.

He noted an all-time high in the NYSE advance-decline line, which compares advancing and declining stocks, as indication of strong participation in the rally off November lows.

"Pull-backs are buying opportunities," said Wald. "There has been really great participation on this move, a lot of small- and mid-cap stocks behaving well, pushing out to the upside; we're seeing some good leadership from offensive sectors of the market as well."

A high ratio of advancing stocks to declining issues shows there is broad participation across the equity market.

The Santa seasonality covers the last five trading days of the year and the first two of the new year. Since 1928, the S&P 500 has averaged a gain of 1.8 percent during this period and risen 79 percent of the time, according to data from PrinceRidge.

The Dow Jones industrial average <.dji> dropped 51.76 points, or 0.39 percent, to 13,139.08. The Standard & Poor's 500 Index <.spx> fell 3.49 points, or 0.24 percent, to 1,426.66. The Nasdaq Composite Index <.ixic> lost 8.41 points, or 0.28 percent, to 3,012.60.

The S&P 500 is up more than 13 percent for the year, having recovered nearly all the losses suffered in the wake of the U.S. election. The yearly gain would be the best since 2009.

Some U.S. lawmakers expressed concern on Sunday the country would go over the cliff, as some Republicans charged that was President Barack Obama's goal. Talks are stalled with Obama and House of Representatives Speaker John Boehner out of Washington for the holidays.

"It does seem like we are continuing through the same drift of the same thing we've had the past couple of weeks - 'cliff' talk," said Nick Scheumann, wealth partner at Hefty Wealth Partners in Auburn, Indiana.

"You can't trade on what you don't know and we truly don't know what they are going to do," he said.

Congress is expected to return to Washington next Thursday as President Barack Obama returns from a trip to Hawaii. As the deadline draws closer, a 'stop-gap' deal appears to be the most likely outcome of any talks.

Trading volume was muted, with U.S. equity markets closing at 1 p.m. (1800 GMT) ahead of the Christmas Day holiday on Tuesday.

In addition, a number of European markets operated on a shortened session, with other markets closed.

U.S. retailers may not see a sales surge from this weekend as ho-hum discounts and fears about imminent tax hikes and cuts in government spending give Americans fewer reasons to open their wallets in the last few days before Christmas.

Aegerion Pharmaceuticals Inc said the U.S. Food and Drug Administration approved Juxtapid capsules in patients with homozygous familial hypercholesterolemia, but will conduct a post-approval study to test long-term safety and efficacy. Shares fell 1.8 percent to $25.25.

Herbalife Ltd dipped 4.4 percent to $26.06 after the company said it expects to exceed its previously announced repurchase authorization guidance and has retained Moelis & Company as its strategic adviser. The declines put the stock on track for a ninth straight decline.

Yum Brands Inc advanced 1.8 percent to $65.01 after Shanghai's food safety authority said the level of antibiotics and steroids in the company's KFC chicken was within official limits.

Wet weather holds off for Christmas Eve bonfires, but threat of ...

The threat of wet weather fouling up Papa Noel's bonfires along the Mississippi River levees in Louisiana on Christmas Eve has abated, according to the Slidell office of the National Weather Service. But there's still a good chance of severe weather, even tornadoes, for Christmas Day, according to forecasters.

"Precipitation is not expected to be an issue for the early evening hours along the levees of the Mississippi River for the bonfires that many municipalities are holding," said the weather service's Monday afternoon forecast.

But conditions remain in place for a significant outbreak of severe weather across the area on Christmas Day, mainly during the afternoon and evening hours. That's the result of a complex series of meteorological processes, including an upper air low that will drop out of the Rocky Mountains Monday night, even as a cold front that is struggling to move south through the area this afternoon makes a u-turn as a warm front.

That warm front will have moved north, leaving the atmosphere over the New Orleans area warm and wet. Upper air windshear should build during the day, increasing the risk of development of major thunderstorms.

"Basic scenario will be development of a squall line in advance of the upper vort max ( meteorologist slang for an upper area of rapidly moving air), with discrete supercells (strong thunderstorms) in advance of the line carrying the potential for long track tornadoes," said the forecast. While the biggest threat is from 3 p.m to 10 p.m. Tuesday, the chance of severe weather could begin as early as 3 a.m., and occur at any time during daylight and early evening hours, the forecast said.

The rough weather will be followed by plummeting temperatures, with below freezing lows likely throughout the area by Thursday morning, though no freeze warnings are anticipated.

Stocks fell in light trading Monday during a shortened holiday trading session with lawmakers running out of time to reach a budget deal that would prevent the U.S. from going over the so-called fiscal cliff.

The Dow Jones industrial average fell 51 points to 13,140. The Standard & Poor's 500 index gave up 4 points to 1,426. The Nasdaq composite slipped 9 points to 3,012.

In more than a dozen interviews with The Associated Press, conservative activists said they would rather see the country fall off the cliff than agree to any tax increases for any Americans, no matter how wealthy.

With many in Washington away for the holidays, that scenario appears increasingly likely.

"There is starting to become a little bit of an acceptance that we fall off the fiscal cliff," said JJ Kinahan, chief derivatives strategist for TD Ameritrade. "People are starting to think about how they may plan their portfolio if that does happen."

Stocks fell sharply Friday, with the Dow logging its biggest drop in more than a month, after House Republicans called off a vote on tax rates. That left federal budget talks in disarray just days before sweeping tax increases and government spending cuts are scheduled to take effect.

Sen. Joe Lieberman said Sunday that it "It's the first time that I feel it's more likely we'll go over the cliff than not," following the collapse late Thursday of House Speaker John Boehner's plan to allow tax rates to rise on million-dollar-plus incomes. Wyoming Sen. Jon Barrasso, a member of the Republican leadership, predicted the new year would come without an agreement.

Failure to agree on a budget plan before year-end would lead to simultaneous spending cuts and tax hikes that many fear may push the economy back into recession.

President Barack Obama and Congress are on a short holiday break. Congress is expected to be back at work Thursday and Obama will be back in the White House after a few days in Hawaii.

J.C. Penney Co.'s stock jumped after Oppenheimer analysts reiterated a "Buy" rating on the company Monday, saying that traffic in stores in the final weekend before Christmas was strong. The analysts said that this made them more optimistic that the company's new approach to promotion will help it through the holidays and into 2013.

The stock jumped 31 cents to $19.88, putting it among the best performers in the S&P 500.

Other retailers may struggle thought this holiday season though, as Christmas shoppers rein in their spending, their spirits dampened by concerns about the economy and the aftermath of shootings and storms. Marshal Cohen, chief research analyst at NPD Inc., a market research firm with a network of analysts at shopping centers nationwide, estimates customer traffic over the weekend was in line with the same time a year ago, but that shoppers are spending less.

Shoppers are increasingly worried about the fiscal cliff deadline, adding to the fall's retail woes after Superstorm Sandy's passage up the East Coast.

Consumer spending drives about 70 percent of economic growth, so how confident they are about parting with money is crucial for any economic recovery.

Falling stocks outnumbers gainers by a ratio of about four to one in the 30-member Dow, with technology companies leading the decliners. Hewlett-Packard fell 43 cents to $13.92 and Microsoft Corp. dropped 43 cents to $27.02.

Stocks may also come under pressure in coming days as investors who have seen their holdings gain this year, decide to sell and book the capital gains tax in 2012 so as to avoid any potential increase in that tax rate next year, according to Kinahan, of TD Ameritrade.

"People who have had a nice year in a particular stock may say 'why not take the hit this year?'," said Kinahan.

Still, barring a dramatic sell-off in the year's final days of trading, stocks will end the year higher on signs that the U.S. housing market is recovering and the U.S. economy is adding jobs. The Federal Reserve also announced a third-round of its so-called quantitative easing program in September. The program, intended to lower the cost of borrowing and spur lending, helped underpin demand for stocks.

The S&P 500 is currently 13 percent higher for the year, the Dow is almost 8 percent up and the Nasdaq is nearly 16 percent higher.

Trading volumes were lower than average today before the Christmas holiday Tuesday. The stock market will close at 1 p.m. Monday and will reopen Wednesday.

The yield on the 10-year Treasury note rose 1 basis point to 1.78 percent.

Among other stocks making big moves:

?Herbalife Ltd., the nutritional supplements company, fell $1.54 to $25.71. The stock has tumbled 43 percent this month after William Ackman, the founder and CEO of hedge fund Pershing Square Capital Management L.P., claimed that the nutritional supplements company is a pyramid scheme.

NASA Plans To "Lasso" Asteroid and Turn It Into Space Station

People keep touting the idea of mining metals from asteroids and using it to build spacecraft outside of the earth's gravity well, but do we actually know how to do that?

The mining side of things seems relatively straight-forward (not easy, but you wouldn't need anything radically new), but smelting and refining significant amounts of ore in low gravity could be rather difficult. As far as I understand, a traditional iron smelting plant uses gravity to help with the purification, allowing the slag to float to the surface, before tapping the good quality iron from the bottom of the blast furnace.

It seems like purifying and working ore in space would require entirely new ways of working with the raw materials. Perhaps using some kind of high temperature centrifuge to spin and separate the material.

I'm not saying it's not possible, but it doesn't seem quite as easy as some of the more excitable science-fictiony plans for space exploration treat it. Many of these plans feature major problems to solve that get glossed over as minor technicalities.

Slow Cooker Mulled Wine {Low Sugar}

Ingredients

• 1 bottle, 750mL, red wine (I use Merlot)
• zest of 1 orange
• 1 orange, peeled, segmented
• 2 cinnamon sticks
• 1 small piece of ginger root (about 1-inch piece)
• 2 tablespoons Maker's Mark Brandy
• 10 packets Sweet'N Low sweetener

Instructions

• Combine all ingredients in the slow cooker pot.
• Stir and cover.
• Cook on LOW for 4 hours or on HIGH for 2 hours.
• Ladle into mugs without the spices.
• When serving, take the lid off and leave the slow cooker on LOW or WARM.

Oman holds first municipal elections

MUSCAT, Oman (AP) ? Oman says more than 1,400 candidates are competing in the Gulf nation's first municipal elections, a concession following Arab Spring-linked unrest.

Oman has seen sporadic protests demanding more job opportunities and a greater public voice in the tightly run sultanate.

The official Omani News Agency says the candidates, including 46 women, are vying Saturday for 192 seats on local councils that have no direct powers but will serve in an advisory role.

Gulf Arab leaders have managed to ride out the region's upheavals, but have promised some limited reforms and offered financial incentives such as expanding state jobs.

Strategic Oman shares control of the Strait of Hormuz with Iran. The narrow waterway at the mouth of the Persian Gulf is the route for one-fifth of the world's crude oil.
